Gaya college of engineering fee refund issue

I had taken admission in gaya college of engineering in 1st councelling ,but i had alloted bhagalpur college of engineering in 2nd councelling, as per the rule of aicte the admission fee will be refunded if you are alloted in any new college. but the osd of gaya college of engineering is saying that he will not refund the money. the gaya college of engineering comes under the science and technology department of bihar government.. other colleges like bce bhagalpur,dce dharbhanga etc had refunded their money already... it is now 3 year to go but the osd of college is not refunding the money.. say what we have to do
